These Terms and Conditions ("Terms") govern the use of the website herastudios.be and any services provided by Hera Studios, located at Sepulkrijnenlaan 65, 3500 Hasselt, Belgium ("we", "us", "our"). By accessing or using our website, you agree to be bound by these Terms.

Hera Studios provides digital design and development services specialising in luxury vacation rental properties. Our services include, but are not limited to:
The specific scope, deliverables, timeline and pricing of each project are agreed upon in a separate written proposal or contract before work commences.
All proposals issued by Hera Studios are valid for 30 days from the date of issue, unless stated otherwise. A project commences only upon written acceptance of a proposal by the client, either via email or signed agreement.
Any changes to the agreed scope of work must be discussed and confirmed in writing by both parties. Additional work beyond the original scope may be subject to additional fees.
Payment terms are defined in the project proposal or service agreement and may include one of the following structures:

Late payments may incur interest at a rate of 10% per annum, in accordance with Belgian law, plus a fixed compensation of 40 EUR for recovery costs.

Delays caused by the client's failure to provide required materials or feedback may result in adjusted timelines and, where applicable, additional fees.
All work, designs, code, assets and deliverables remain the exclusive intellectual property of Hera Studios until all outstanding fees have been paid in full. This includes, but is not limited to, website designs, source code, visual assets, and any custom-developed components.
Upon full and final payment of all fees:

For subscription-based agreements: the website remains hosted and managed by Hera Studios for the duration of the subscription. If the subscription is cancelled or payments lapse, the website will be taken offline after a 14-day grace period following written notice.
Both parties agree to keep confidential any proprietary information, business strategies, financial details or other sensitive information disclosed during the course of the project. This obligation survives the termination of the agreement.
Hera Studios shall not be held liable for:
Our total liability for any claim arising from a project shall not exceed the total fees paid by the client for that project.
If a maintenance agreement is in place, Hera Studios will provide ongoing support as defined in the agreement. This may include security updates, content changes, performance monitoring and technical support.
Maintenance agreements are billed monthly or annually and can be cancelled by either party with 30 days' written notice.
Either party may terminate a project agreement with 14 days' written notice. In the event of termination:
For subscription-based agreements: the client may cancel with 30 days' written notice, effective at the end of the current billing cycle. Early termination does not entitle the client to a refund of the current billing period. Upon termination, the website will be taken offline after a 14-day grace period unless alternative arrangements are agreed in writing.
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, war, government actions, pandemic, or internet service disruptions.

These Terms shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Hasselt, Belgium.
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of our website or services constitutes acceptance of the updated Terms.
